Terms and conditions of the “ U by Kotex^® Win $3,000 towards the training you want” promotion

Information on how to enter the “U by Kotex® Win $3,000 towards the training you want” promotion (Promotion) and the prizes form part of these Terms and Conditions. By participating in the Promotion you accept these Terms and Conditions.
The Promoter is Kimberly-Clark Australia Pty Limited, trading as Kimberly-Clark New Zealand, Level 2, 123 Carlton Gore Road Newmarket Auckland 1023, Tel: 0800 733 703 (Promoter).
Entry is only open to New Zealand residents who are aged 13 years or over. (Entrant). If any winner is under the age of 16 years their parent or legal guardian must give their prior written consent to the award of the relevant prize.
Employees of the Promoter and their immediate families, affiliated retailers and agencies associated with this promotion are ineligible to enter.
Entries open at 12.01am NZST on 3/08/20 and close at 11.59pm NZST on 31/08/20. This is stated as the Promotion Period.
To enter, Entrants must, during the Promotion Period:
1. Purchase any 2 packs of U by Kotex® products in one transaction at any participating New World stores Nationwide between the Promotional Period (Qualifying Purchase); and
2. Text your name and ‘train” to 2012 to be in the draw to win. You must retain valid receipt as proof of purchase. Standard mobile charges apply.
Maximum one entry per Qualifying Purchase.
Each winner will win the following prize(s):

The 3 eligible prize winners will win $3,000 via Prezzy Card (pre paid Visa) that can be used to fund winners personal training interest. Prize money is to help cover set up costs, professional counsel and associated gear/equipment. The maximum total prize pool value is $9,000 RRP.
Prezzy gift cards are subject to Kiwibank Limited’s terms and conditions as specified on the website at: https://www.prezzycard.co.nz/terms-conditions/ relevantly including:
1. That the card is valid for at least two years from the date of purchase. The expiry date is printed on the front of the card. The card can’t be used after expiry, and unused value remaining on expiry will automatically be forfeited.
2. Fees apply for currency conversion, using the customer service line, disputing a transaction, online ordering and replacement cards. These are deducted from unused value on the card. See the Website for details.
The prize, or any unused part of the prize, is not transferable or exchangeable and cannot be taken as cash.
Prize Winners will be drawn by Raydar Limited New Zealand (Agency) on behalf of the Promoter by a single draw from all valid entries. The draw will take place at 12:00pm NZST on 14 September 2020 at the office of the Agency at 318 Richmond Road, Grey Lynn, Auckland. The Promoter will notify the winner how they will receive their prize.
The winners will be announced within 10 working days of the date of judging by phone using the details supplied from the Entrant’s competition text entry.
If for any reason a winner does not redeem the prize or a part of the prize within 7 days from the date on which the Promoter first attempts contact with the winner, then the prize or that part of the prize will be forfeited and cash will not be awarded in lieu of that prize or element of that prize.
Judging will be conducted to distribute any unclaimed prize within 14 days following the Initial Judgment at the same place as the original judgment (Unclaimed Prize Judgement). The new winner(s) of the Unclaimed Prize Judgement will be announced and notified by phone within 21 days following the Initial Judgement.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants’ details and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Incomplete, indecipherable or illegible entries will be invalid.
By submitting an entry in this Promotion, the entrant declares that their entry is their own original work and not copied in whole or in part from any other person, and that the entry does not infringe the Intellectual Property Rights of any third party.
The entrant acknowledges that by submitting an entry in the Promotion, the entrant waives any right to inspect or approve any use, edit or reproduction by or on behalf of the Promoter of all or any part of the entrant's entry, including anything which may be created in connection with the entrant's entry.
The Promoter’s decision is final and the Promoter will not enter into any correspondence with entrants other than winners in relation to this promotion or the prize.
The Promoter reserves the right, at its sole discretion (subject to any applicable law) to extend, modify, suspend, terminate or cancel the Promotion, for any reason whatsoever, including (without limitation) if the Promotion is interfered with or is not conducted as reasonably anticipated for any reason.
The Promoter and its agents will not be liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize except for any liability which cannot be excluded by law.

Entrants consent to the Promoter using their name, likeness, image and voice in any media for an unlimited period without remuneration for the purpose of promoting the Store and this Promotion.
